By using the Service, you acknowledge and agree to the terms of this Disclaimer.
This Disclaimer forms part of, and is incorporated by reference into, the Company’s Terms and Conditions. In the event of any conflict between this Disclaimer and the Terms and Conditions, the Terms and Conditions govern. Automated actions through WordPress plugin/API access, Bymiles-hosted sandbox WordPress environments, and integrations with coding agents such as Claude, Cursor, or other tools that call Bymiles APIs or MCP endpoints
Design, content, code, site-management, and functionality recommendations and modifications
Other automated actions performed on your behalf, including actions on production, staging, local, or sandbox WordPress environments
To provide these features, we may utilize third-party AI model providers, hosting providers, infrastructure vendors, coding-agent integrations, application stores, payment processors, and other service providers. A current list of our key sub-processors and third-party providers is maintained at [URL] and is incorporated by reference. Key providers as of the date of this Disclaimer include:
Anthropic – for content generation, code assistance, instruction interpretation, and automated actions
Google – for content generation, code assistance, instruction interpretation, and automated actions
OpenAI – for content generation, code assistance, instruction interpretation, and automated actions
Your use of AI features may also depend on or be subject to these providers’ and integrations’ terms, policies, availability, rate limits, security practices, data retention practices, and performance. We do not control those third parties and do not guarantee uninterrupted availability, accuracy, security, rollback capability, or performance of any third-party AI model, hosting service, coding-agent integration, payment provider, application store, WordPress plugin, theme, hosting environment, or other third-party component. Miles is an AI-powered tool and may make mistakes, misunderstand instructions, make poor design, content, or code decisions, over-scope or under-scope requested work, or take actions that differ from what you intended.
AI-generated outputs do not represent the views, opinions, or endorsements of the Company, its employees, affiliates, or any individuals or organizations. The content is generated by machine learning algorithms and should not be attributed to any human author or interpreted as the official position of the Company on any matter.
We make no representation or warranty regarding the accuracy, reliability, completeness, suitability, safety, recoverability, availability, compatibility, or quality of any content, code, designs, configurations, instructions, recommendations, automated actions, or other outputs generated or performed by the AI features. AI-generated outputs and actions may:
Contain errors, inaccuracies, or incomplete information
Be misleading, outdated, or factually incorrect
Produce unexpected, unintended, over-scoped, under-scoped, or hard-to-detect results
Vary in quality and may not meet your specific technical, design, business, legal, accessibility, security, performance, revenue, or operational needs
Not be unique and may be similar to outputs generated for other users
You are solely responsible for supervising Miles, reviewing, verifying, testing, and approving all AI-generated content, code, configurations, recommendations, and automated actions before publishing, deploying, applying, or relying on them.
By using the AI features, you agree that:
You will carefully evaluate, review, test, and approve all AI-generated outputs and automated actions before publishing, deploying, applying, or otherwise using them
You are responsible for ensuring AI-generated content complies with all applicable laws, regulations, and third-party rights
You will not publish, deploy, apply, or use AI-generated content, code, configurations, or automated actions without appropriate human review and testing
You assume all responsibility for the content, data, information, settings, code, plugins, themes, configurations, access credentials, access tokens, and site changes generated, modified, deleted, overwritten, installed, removed, or otherwise affected through the Service
You are responsible for any consequences arising from your use of AI-generated outputs or automated actions, including site crashes, downtime, broken functionality, lost revenue, deleted or overwritten content, security issues, failed rollbacks, third-party service failures, and impacts to your customers, clients, or end users
You must use staging, local, or sandbox environments where practical before applying changes to a production site
You must maintain current, restorable backups and appropriate version-control or change-management practices before granting Miles live write access or asking Miles to modify production systems
If you unlock, enable, confirm, approve, or otherwise permit Miles to act on a production site, you assume the risk that Miles may make changes to that production site, including changes that affect revenue-generating pages, core functionality, plugins, themes, settings, content, code, security posture, or availability
When using, publishing, or sharing AI-generated content, you agree that:
You will not represent AI-generated content as being entirely human-created when such representation would be misleading or deceptive
You will not represent AI-generated content as being entirely AI-created if you have substantially modified or edited it
You are responsible for any representations you make about the origin or authorship of content created using the Service
If you use the Service to create websites, content, or other materials that will be accessed by your own customers, clients, or end users, you acknowledge and agree that:
You are solely responsible for informing your end users about your use of AI-generated content where required by applicable law or industry standards
You are responsible for ensuring that AI-generated content deployed to your end users complies with all applicable laws and regulations
You will not use AI-generated content in a manner that deceives your end users about the nature or source of the content
Any claims, disputes, or issues arising from your end users’ interaction with AI-generated content, automated site changes, or any other outputs or actions performed by Miles are your sole responsibility
In addition to the Content Restrictions in our Terms and Conditions, you may not use the AI features to:
Generate content intended to deceive others about AI involvement
Create deepfakes or synthetic media of real individuals without their consent
Generate content designed to manipulate, defraud, or mislead others
Produce content that infringes on third-party intellectual property rights
Create spam, phishing materials, or malicious content
Generate illegal content or content that promotes illegal activities or violence
Impersonate individuals, organizations, or AI systems
Circumvent safety measures or content filters in AI systems
Use outputs to train competing AI models without the Company's prior written authorization
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your acts or omissions in connection with:
Your use of or reliance on AI-generated content, code, configurations, recommendations, or automated actions
Claims that AI-generated content, code, designs, site changes, or other outputs created or modified through your use of the Service infringe, misappropriate, or violate third-party rights
Your failure to comply with this AI Disclaimer, our Terms and Conditions, our Privacy Policy, or applicable laws regarding AI-generated content, automated actions, data, security, privacy, consumer protection, accessibility, or your website and end users
Your representations about AI-generated content to third parties
Any claims brought by your customers, clients, or end users related to AI-generated content, site changes, automated actions, downtime, broken functionality, deleted or overwritten content, data handling, or your use of Miles
You retain ownership of content you create using the Service, subject to our Terms and Conditions. However, the Company makes no representation that AI-generated content, code, designs, or other outputs are eligible for copyright or other intellectual property protection in any jurisdiction, and:
We cannot guarantee that AI-generated content, code, designs, layouts, media, themes, templates, or other outputs do not infringe, misappropriate, or otherwise violate third-party intellectual property, privacy, publicity, contractual, platform, accessibility, security, or other rights or requirements
You assume all liability for claims that AI-generated content, code, designs, site changes, or other outputs infringe, misappropriate, or otherwise violate any third-party rights or requirements
You are responsible for conducting appropriate legal, technical, security, accessibility, performance, brand, and business due diligence before using AI-generated content or automated site changes commercially or on a live site
Miles runs on Bymiles servers as the AI “brain” and interacts with WordPress sites, Bymiles-hosted sandbox environments, and connected services through plugins, APIs, MCP endpoints, and other integrations. The Service may perform automated actions on your production, staging, local, or sandbox WordPress installation and connected services on your behalf, including but not limited to:
Installing, activating, deactivating, configuring, updating, adjusting, or removing plugins and themes
Creating, editing, modifying, deleting, overwriting, restructuring, or replacing website content, pages, posts, media, navigation, templates, layouts, styles, and code
Changing website configurations, settings, permissions, credentials, access tokens, API keys, integrations, database records, and hosting- or environment-specific settings (the Company uses commercially reasonable security measures to protect credentials and access tokens in transit and at rest, but cannot guarantee that no unauthorized access will occur)
Deleting, overwriting, publishing, unpublishing, moving, or changing existing content or revenue-generating pages
Making database, theme, plugin, configuration, content-management, and code modifications that may be difficult or impossible to identify, isolate, reverse, or fully roll back
By using the Service, you expressly authorize Miles to perform these actions, including actions that may modify, delete, overwrite, publish, unpublish, or otherwise affect existing content, code, configuration, plugins, themes, settings, credentials, access tokens, or connected services. If you unlock, enable, confirm, approve, or otherwise permit production-site access or live write access (including through any in-product confirmation, modal, or "unlock" step), you acknowledge that you are choosing to allow Miles to act on that environment, that you have confirmed appropriate backups are in place, and that you assume the risks of doing so. We may log such confirmations for record-keeping purposes.
You acknowledge and agree that:
Automated actions may result in data loss, content deletion, content overwriting, broken functionality, website malfunction, site crashes, downtime, revenue-generating pages being offline, SEO or analytics disruption, or security exposure
Plugin installations, theme changes, code edits, setting changes, hosting limitations, WordPress limitations, API limitations, permission issues, and conflicts among WordPress, hosting providers, plugins, themes, databases, caching layers, security tools, or coding-agent integrations may cause instability, downtime, incomplete results, or unexpected behaviour
Actions taken by Miles, whether in a Bymiles-hosted sandbox, your own sandbox, staging, local, or production environment, cannot always be undone, and any undo, revert, restore, rollback, history, snapshot, or sandbox reset feature may be limited, incomplete, unavailable, delayed, or unsuccessful
You are solely responsible for maintaining current, complete, tested, and restorable backups of your website, database, code, themes, plugins, settings, configurations, credentials, and all content before using the Service, especially before enabling live write access or applying changes to a production site
We strongly recommend using staging, local, or sandbox environments for review and testing before applying changes to production sites, and you are responsible for determining whether a change is safe to apply to a live site
We are not liable for any damage, data loss, corruption, downtime, lost revenue, lost traffic, broken functionality, security compromise, credential or access-token exposure, customer impact, rollback failure, or other issues resulting from automated actions, regardless of whether such actions were requested by you, approved by you, initiated by the AI, triggered through a coding-agent integration, or affected by a third-party provider, WordPress, hosting, plugin, theme, API, or configuration limitation

Data loss, content deletion, content overwriting, database changes, code changes, configuration changes, website malfunction, broken functionality, security compromise, credential or access-token exposure, or hard-to-rollback changes
Plugin, theme, hosting, WordPress, API, database, cache, security-tool, coding-agent, or other compatibility, availability, rate-limit, permission, or integration issues
Website downtime, unavailability, degraded performance, revenue-generating pages being offline, lost traffic, lost revenue, SEO impact, analytics disruption, or end-user impact
Security vulnerabilities or exposures introduced by, resulting from, or arising in connection with third-party plugins, themes, hosting providers, AI model providers, coding agents, APIs, access credentials, access tokens, configuration information, or other integrations
Any other issues resulting from changes made to your WordPress installation, Bymiles-hosted sandbox, connected services, third-party processors, payment providers, application stores, hosting providers, AI model providers, coding-agent integrations, or other third-party components
We do not use your personal data or content to train our own AI models
Aggregated, anonymized usage data may be used to improve the Service (such as improving performance, reliability, safety, and user experience), but not to train AI foundation models
Your inputs, instructions, prompts, content, files, code, configuration information, site information, credentials, access tokens, API keys, outputs, and usage information may be processed to provide the Service and are handled in accordance with our Privacy Policy.
